Do US airlines owe cash compensation for delays?

The short answer

The US federal refund rule in 14 CFR Part 260 requires refunds, not cash compensation for delays. In December 2024 the Department of Transportation published a proposed rule considering cash compensation, rebooking and meals, but the official page does not confirm that any such requirement has taken effect.

What the current refund rule covers

Part 260 sets refund rights for cancelled or significantly changed flights, unprovided ancillary services and lost or significantly delayed bags. The text we read had no section for cash compensation for delays. It defines a cash equivalent only as a payment method usable like cash, and it allows vouchers only as an alternative to a refund.

The 2024 proposal

The Federal Register shows a Proposed Rule titled Airline Passenger Rights, published 11 December 2024. DOT said it is considering requiring airlines to give affected passengers cash compensation, free rebooking and amenities such as meals, lodging for overnight delays and transport to and from lodging. It also asked whether protections should apply in any type of disruption, and how to decide whether a delay is within an airline's control. Comments were due by 10 February 2025.

What the official page does not verify

A proposal is not a rule. the official page does not read the DOT delay dashboard page or later rulemaking documents, so I cannot confirm what, if anything, has been finalised, or which airlines promise meals or hotels voluntarily. Check the DOT website and your airline's policy.

UK comparison

UK CAA guidance is different: compensation of £220 to £520 can apply where you arrive more than three hours late and the airline caused the delay. That regime does not apply to a US domestic flight.

Do I still get a refund?

Yes, if your flight is cancelled or significantly changed and you do not accept the alternative, Part 260 provides for a refund.

What would the proposal have covered?

Cash compensation, free rebooking, meals, lodging for overnight delays and transport to and from lodging.

Can an airline offer a voucher instead?

Only as an alternative to a refund, and you must affirmatively accept it.

Do UK rules apply on US flights?

UK compensation rules are separate and do not govern a US domestic flight.
